Default buying from owner#2 but title is still under owner #1..

car was advertised as one owner..

The guy told me he bought from the ORIGINAL owner 3 months ago but didn't register in his name yet, he has been driving it around I guess he didn't officially go to the DMV to pay the tax. Sticker still good till 2014.
He bought another car so he wanted to sell this one now.

He said if I buy this car I will be the second owner.

Does it sound legit or does anyone detect some a pattern of potential scam. If I'm buying the car I am not going to be handing over the check until we both finish the DMV paperwork (@ AAA) .. otherwise does anyone see any problems?

here is what I found on the DMV site:

"NOTE: Transfer fees are due within 10 days of the “sale.” Penalties are assessed if payment is not received by DMV within 30 days of the “sale. If multiple sales occur before DMV is notified, a separate transfer fee is collected for each sale when the application for transfer is received by DMV."

However it seems Transfer fee is only $15.. I guess it would have to be determined if the guy has filled out the title or not yet.?

If the pink slip does not have his name on it, I would stay clear away. Technically, DMV sees it as vehicle belongs to Owner #1.

Otherwise, You are just asking for a lot of headache.

Sold car like this many time and no problem. Just go directly to the DMV and all you need is another bill of sale from him to you with the updated mileage and you're good. I prefer going in the DMV with him tho to make sure everything go thru.

I bought a car like that for a friend before, except it was like 2 weeks within the sale of first owner. Bought it with the 1st owner's signature etc, put down my info and registered with no issue. Did seem sketch at first

A friend of mine flips cars like this all the time...but he does it with civics and integras.

You have to pay sales Tax in vehicle. It's not in buyer #2 name until its paid it's going to be a wait until title is sent to DMV . And put in his name, so it can be purchased by you. It can be dealt with at DMV

I'm looking at other car, this time, is this one safer?



Hi Stock4AG, we are selling this car for our brother-in-law who recently relocated from XXX,CA to YYY,CA

The car, all the paperwork, the title, etc are in our possession here in XXX. The owner (John Doe) is available by phone for any detailed questions you may have.



If things need to be done properly, I think the owner needs to sign the title.. but it's not like the DMV really cares that much.

Same here, have a friend who has probably done it a hundred times or more.

its legit as long as he can prove it. i seen it done. make sure the line of communication stays open.

It's very do-able as long as all the paper work is there including bill of sale from the first and "second" owner.
