Suing a Lexus Dealer?
Back in December 2020, I purchased my CPO 2017 NX 200t AWD F-Sport. I brought it to a dealer some time after I purchased it. During the service, a technician showing a video of the underside of my NX, mentioned that there was a dry seepage under the water pump. The invoice stated that it was leaking and stated "Customer Declined Service" Two months later, I brought it back in and said please change the water pump under Lexus CPO warranty. Service writer writes up the invoice to change water pump. After further review from a technician, he states that it is not wet and therefore not leaking and no repair work needed. Again, "Customer Declined Service" I file a claim with BAR claiming I never declined any service under warranty and that Lexus should remove the statement "Customer Declined Service" because it makes it look like I wasn't willing to have the work done. After months of back and forth with BAR and the Lexus service manager. So, no new water pump. I purchase a new Tesla and decide to sell my NX and under full disclosure to a prospective buyer, he sees that the water pump was leaking and on separate invoice that it's not, but was scared to purchase my NX . Do I have a case against Lexus in court?

These cases are very hard to win. It takes a lot of time and money. Your best bet is to talk to a lawyer. But you really need to weigh the outcomes (if).

Why didn’t they replace the water pump the first time the technician noticed it?
Did they say bring it back at a later time or something?

Temporary leak vs Active leak, from my understanding the pump design allows for seepage of small amounts under certain circumstances , but then clears up with no requirement to replace.
As long as there is no noise or active leakage, there really is no problem.
Find out what the replacement cost would be and be prepared to either pre emptively replace or use as bargaining discount for potential buyer. That would be much, much cheaper then suing anyone, and much less stressful in the long run.

Water pump failure is fairly common on the 2.0 turbo in IS and NX. Honestly a water pump is not a big deal cost wise.
since it's not actively leaking you don't have much to worry about.
if you want to preemptively get it taken care of, just foot the bill. whatever bill that is would be absurdly cheaper than "suing."
