Hello, I have a 2023 NX350h, which is currently in the body shop because of an accident, that I thought, would have been mitigated (pun intended) by the vehicle braking. The car was driven into a fairly decent sized TREE-should collision mitigation have applied the brakes (the driver had not) and was going less than 10mph? In defense it was raining, but is the system that limited? I wonder if it would've worked in clear weather. Gotta also tell you, was shocked at the amount of damage-impact dead-center of hood and it folded like the proverbial "tin can". So far, $23,000 plus estimate, and still evaluating the damage. Has anybody else had a similar experience and is this something that could be deemed a failure of the Lexus Safety System? Not sure if this is basically a poorly designed system by Toyota or a defect of my car. If you look at the list of exclusions for their safety systems, basically they list more circumstances in which they will not work, than they will. I know this was driver error, but I thought the pre-collision mitigation would've worked.
Do you think this should be filed with NHTSA?

My wife pulled in to an old gas station parking lot to mess with her phone. What she didn't realize was that she parked pretty much in front of the concrete things they used to [ut up to protect the pumps. She didn't see it because of how high the front of the car is. When she went to start driving ( a little aggressively because she was running late) the system let her smack in to it taking out the left front tire then totaling the front driver door. I, too, thought the system should've prevented this, but no such luck. It does, however, stop you from pulling in to the garage far enough.

Can't depend on any of the mitigation features. However our X3 was backing up and it abruptly braked/stopped before I hit a garage door at a store unit.
