I'll be sure to bring that up because on their estimate is says "not drivable" also I need to look at the hours but I think they tried to stiff me there too. I checked legal web pages and they said 4 hours of shop work = 1 day LOU + 2 days to include weekends every 5 days + 3 days are set aside for getting in contact ect. The thing I did notice though is that all of the pages stated that LOU is maxed out to 30 days

Rental info:
WAC 284-30-3915
Washington State Register filings since 2003
What if the other person's insurer offers a flat rental amount per day, week, or month?
When the insurer offers a flat rental amount per day, week, or month, they must disclose to you where you can obtain a vehicle for the amount of its payment.
WAC 284-30-3914
Washington State Register filings since 2003
When I am dealing with someone else's insurer, what are my rights regarding a rental vehicle?
In vehicle property damage liability claims in which liability is reasonably clear, the insurer will negotiate the reasonable and necessary costs in direct proportion to the extent of its liability for the rental of another vehicle and may not require you to rent a vehicle to actually cover these costs.
From what I know, when somebody else hits you and they are at fault, their insurance company cannot enforce their rules on a limitation on how many days they will pay out for rental. Usually the maximum days is 30 days or depending on your policy with your own insurance company.
However since you're not going through your insurance company they have to pay you LOU when your vehicle is inoperable to the day when the body shop clears it for use. They owe you the amount plus tax for LOU.
