Default Day 4 - The Nightware Begans

On 8/12/09 a pallet was delivered to the house.

What was delivered was unanticipated and unplanned for.

What was ordered:

4 used and abused SUV tires and rims
1 domestic tranny
1 domestic torque converter

The pallet was REJECTED

I immediately contacted the seller, David from Snap Performance. He was genuinely surprised of the news.

Much speculation starts.

8/14/09

The pallet sits at the New England Motor Freight (NEMF) Harrisburg, PA terminal.

Agreed with David, the owner of Snap Performance, to give it a week just in case the pallet is found somewhere, some how. We thought it would be best if I don't spend the weekend putting back the sc300, in case the 2jzgte engine/tranny was found.

However, a dead line was set. I told David if things are not straigtened out by the end of the following week, then I will start a dispute with PayPal and cancel the payment on my credit card.

8/15 -8/17

Did a ton of information gathering and analysis.
Spoke to a couple of people off the Club Lexus Forum and Supra Forum.

Got faxes, documents, pictures, etc. Thought about this quite a bit, starting with the facts. I couldn't sleep much, since this nightmare was constantly on my mind.

From what I was able to gather, here are some potential points of failure.

1. Seller
2. Primary Freight company (aaacooper.com)
3. Secondary Freight company (nemf.com)

The seller, David from Snap Performance, was far sighted enough to take pictures of the pallet prior to shipping (8/4). He emailed me those photos prior to the pick up - by the primary freight company. I was able to verify from the primary freight company the items picked up by the trucker, was indeed the items in the pictures.

From that, it is fair to conclude the seller was honest and had no intentions to mislead the buyer.

Spoke with the seller earlier today, and it was acknowledged the best path forward is for me to cancel the transaction with Snap Performance on my credit card, and start a dispute with Paypal. The reason I'm assuming he can't refund the money from Paypal is probably because the money has been used since my initial payment on 7/21/09. Nevertheless, he assured me Snap Performance will refund my full amount and half of the cost of my mechanic fees.

From my stand point, David (the owner of Snap Performance) has been honest,up front and done nothing wrong. The only fault David had, in this fiasco, is poor judgment. He allowed a package of this nature to be insured at less than half of its cost.

Additionally, aaacooper (primary freight company) has not been good when it comes to customer satisfactions and resolution. The primary freight company wants David to allow for the crap on the pallet (4 suv tires and rims, domestic tranny, etc) to be shipped back to him, without conducting any form of investigation and analysis. That, for me, is rather hard to believe since there maybe a security vulnerability happening at their terminals (workers stealing). Next time, maybe a shipment of Iphone can go missing from that terminal.

What do you all suggest? Anything I may of overlooked and not thought of?

Hmmmmmmm.... This is interesting news to me. I got my Lexus from David as well.

I honestly believe he's a good guy, I've been to his house before and he buys his Motors/Trannys from JHOT which is a reputable vendor.

When I took delivery of the car it would not pass inspection because the 1JZ-GTE is OBDI and the car is OBDII (it will never legally pass inspection in Texas ). Also, the power steering leaked, coolant reservoir leaked, the turbos smoked after a full day of driving it, and the coolant looked like swamp water. He said he flushed the coolant when he built the car and it was only Lexus Red, but using a hydrometer it looked to be a mix of mostly water. (dangerous freezing point) That being said, I drove it back up to his shop and he changed the oil for me for free (I provided the oil), and at that point I had already flushed the coolant. The car runs decent now but the power steering is going out and wining. Also, the transmission fluid hose broke over the weekend but I was only half a mile from my house, however nobody can really be blamed for that.

I hope you get everything straightened out and closed with him. As I understand, him and another business partner used to run Snap, but they have since parted ways from each other.

8/22 to 8/23

Spend @ 10 hours total putting back the car. She is now completely back to her original self. Have to say, it's great to have my car back.

Just wanna let every1 know, this incident will not prevent me from seeking out another swap set. It won't! When the opportunity is right, I'll go after another set. Lets hope the I'll take the experience and knowledge I've learned from this instance and thoroughly apply it to the next swap.

i have dealt with david, and he has been a straight shooter with me.

you are pretty local, i suggest checking out two engine places in nj, i bought my motorset from them.

I've dealt with david too with no issues, I remember putting you in touch with a local usdm 2jzgte, I'm guessing that didn't work out.
