Question transmission slippin?

I was wondering if anyone has the same problem as I do. In the morning, only when it is cold, my transmission doesn't wanna shift into 1st gear and starts of in 2nd gear. And this causes the transmission to slip like crazy in the morning. What should I do? I changed the fluid (3 quarts) and seems to be over the full mark. Also when It is cold I might have to change my battery pretty soon. Would this be the cause of my problems?

Thanks
