I'm fairly sure you could remove it without throwing any codes as there's nothing monitoring the last one (i.e. no oxygen sensor plugged into it).

I am going to try and post some pics of the x-pipe that I am currently building.
It will cost about $350-400 and requires a bit of cutting/fitting/welding (you could do it considerably cheaper if you used mild steel and started with a "muffler shop" Y-pipe or even the stock one).
Parts used:
- Megan Racing SC430 Y-pipe
- 2.5" X-pipe for 06-up mustang.
I looked at the pics and the angle looked close, so I ordered both parts, when they arrived I laid the X-pipe over the megan piece - it looked like it required only a small bend on each side to make it line up.
First, I cut the "Y" out of the megan piece but before doing that I welded braces across the flanges at the front and then across the pipes in the middle to keep everything aligned. I also drew an outline on the floor - it's not critical at this point because once bolted to the car I will do final fitting before welding. I am also going to add high flow cats and at that point I will tuck the y-pipe as far up as possible for ground clearance.
I used one 90deg. stainless elbow and cut it into a pair of 45's, next I welded them to the x-pipe (they are only tacked right now)
Next, cut the required angle into them to mate up with the megan pipes - once I bolt it up to the car it'll just be a matter of cutting the Y out of the catback and mating them up.
Yeah, I could have made this all from scratch - I did on the other GS I have and it probably took me a whole day of cutting/fitting/welding - but this time I wanted to "cheat a little" and it probably took me all of about 1/2 hour to do it.
