Our resident genius Mandyfig has the very best solution to the problem, he simply ran a bead of silicon on top of the light where the seal is.

I guess I may do the silicon once the headlight gets replaced.

As for the warranty replacement, here is what Thompsun lexus told me -
It is covered under original warranty but not under the CPO warranty. Since my vehicle
still has some original warranty left, I am going to head over to the local lexus dealer
this weekend or early next week.

BTW, this does not bode well for Toyota's commitment to quality. They also said
there were no TSB's on this. I thought I read otherwise here.

Anyone know the status of the lawsuit

Would not place much hope on that. Even if there is some kind of settlement usually what happens is that the lawyers get rich and those affected in the first place get a certificate or rebate towards a future purchase.

I am hoping the lawsuit will force them to acknowledge the issue and
do a recall for replacement.

Went in last week to the local dealer and they agreed to replace the passenger side
headlight assembly. Parts ordered and got it replaced today.
There is a TSB for passenger side, apparently. As for the driver side, I thought i had seen
condensation but it must have been outside because i could not get it to reproduce again.

The dealership claimed that the newer assemblies do not leak any more. Time will tell.

BTW, any way to do the silicon seal of the headlight without removing the bumpers ?
