Hi,
I am locate at CA. Just purchased a new 2011 RX350 yesterday. I have signed the paper, but dealer don't have the car yet until today.
I changed my mind, and would like to know if I can cancel the sale since I didn't get and drive the car from the dealer?
Will be great appreciate for the comments!
If I can, what should I tell the dealer? Need to do it tonight since they just got the car an hour.

You don't own the car until you drive it off the dealer's lot.
Did you give the dealer any cash ? If you gave them cash, then it could get sticky (ie. you may lose it).
If no cash changed hands, then it shouldn't be difficult to cancel the sale.
Regardless, if you don't want the car anymore, just tell them that you want need the car anymore and see how the dealer respond.
These RX350 sells quickly so another buyer will come along.

Thank you. I only paid them with the check, and told them don't cash it out until next Tue. If they agree to cancel it, do they have to put it in writing saying this sale is cancelled?

CA does not have a cooling off period after purchase. If you buy the car, it is yours. There are no returns. But, since you didn't take delivery you should be able to just cancel the purchase. Do it immediately ... let us know how it goes. Interesting issue about when the law kicks in ... when you sign the contract ... or take delivery. Just contact the dealer and tell them that you do not want the car.

The reason I am changing the mind is it doesn't come with park senor. Plus I can save about $7K to 8K if I get one year older RX350. Dealer only offered me 46K for AWD, Navi, Premium.....

If the dealer hasn't cashed the check yet per your request you might contact your bank and have them stop payment on it just in case.

I have a different take on this, and I too live here in SoCal.
I agree with UCSB about the no cooling period. Which only means that from the time you signed the papers the car is yours.
Whether you had a change of heart seconds before you receive the keys or days after your purchase..it's the same banana.
You signed it, without a gun pointed in your head, therefore you're responsible for it.
Expect the worst scenario. Dealer can give you an excuse that they have already filed the paper works with DMV which can be true since everything is done electronically.

Agree, 100%. Don't sign on the dotted line unless you are prepared to close the sale. Anything else is bad form. You are fortunate the dealer cancelled the sale, but I wouldn't want to do business with you in the future. A total waste of the dealer's time and resources.

Guilty of the same thing, sort of. I had a deposit down on a 450h until I realized it wasn't exactly what I wanted. The vehicle was virtually en route to the dealer when I called my sales guy to tell him I didn't want it. He completely understood and issued a refund. A month later I went back to place my special order. It took four months but was totally worth it.
