John007, what ever turned out with that towing damage? Did you end up contacting an attorney? If so what type? I am looking to hire an attorney to sue a towing company that illegally towed my car, I was parked properly but they towed me anyways.. also they broke a few laws in not giving me back my car promptly, and I had to get the police involved in order to get the car released to me!

If the towing company ownes the Judges as they say, sue the restaurant. File a claim on their insurance. If it was a chain go to the HQ's. They don't want the bad publicity.

I think I would get some legal advice as to how you deal with the individual who initiated the tow. That's where your trouble started. The right attorney could make this unpleasant for both the restaurant and the tow company, even though the tow company may claim to be a harmless third party. It sounds like your property wasn't returned to you in the same condition you left it and you were without the use of it for a time. You probably have a claim even if you weren't parked legally as you say. Good luck.
