There might be an adjustment for that, but usually there is some give to allow for complete latching. To test, pull the release and be sure that the second catch grabs hold. As long as you still have to release the second latch from the front of the car, you should be OK.
I think it is not too unusual for hoods not to catch fully when slammed shut; in those instances, which is probably what happened here, the first catch might slip lose at high speed or a bump in the road, and the hood will rise an inch or two and get caught by the second latch. I have had that happen to me once or twice over the last 50 years. I have never heard of the second latch not holding (until now) - that is a frightening thought.

I totally agree with tfischer.
You can raise the rubber cushion pieces to fit really tight, but you will have a major hard time to close the hood.
He didn't post the detailed photos to show us the condition of the two latches and hood lock hooks.
The hood latch mechanism is actually very plain and simple.
It shouldn't be difficult for an insurance adjuster to figure out what caused the failure.
