This could be dumb. So I bought a used 2002 GS 430 from the dealer and I took a 15 min test drive on local roads, nothing out of the ordinary except for the low idle which is common here.

Took it to the highway last week and when I braked, there was a shuddering sound but very little vibration on steering wheel. I checked the brakes and sure enough I need new rotors/pads for the rear. I am also going to do my 90k service so I called up a Lexus dealer to ask for the service history and they told me 90k was not done (as expected) and that on May 8th, the dealer I bought the car from took the car in for an oil change and was informed that the rear brakes had 5-10% left at the most and needed to be changed.

I am still waiting to hear from the dealer I bought this car from but do you think I have to case to ask for this? If not, I will just cancel and buy my own rotors/pads.

The car has 97k miles and it is awesome. I am going to do 90k service next week (water pump, timing belt, serpentine, joints fluids etc etc) and I already bought summer tires since it came with winter tires ugh.

I think you have a good case, especially if they had already known about the brakes needing replacement, that makes a neglectful safety issue.
