missing tires: who's responsible? Lexus, Tire Rack, UPS, FedEx, or me?
Bear with me as I explain the fiasco.... (edit: no tires were involved, only wheels... sorry)
I ordered a set of aftermarket wheels from the Tire Rack a couple of weeks ago.
They were never mounted and I decided to return them. UPS was scheduled to
pick them up from my house on Monday.
I decided to order a set of OEM wheels from a Lexus dealer.(who offered me
a good discount) The wheels were shipped via FedEx last week.
On Monday, the boxes containing the aftermarket wheels were sitting outside
of my house waiting for UPS pick-up. When I came home that evening,
the boxes were gone and I figured UPS had picked them up. (which I confirmed
on UPS's website)
On Wednesday, I called the Lexus dealer and asked where my wheels are and
the parts guy gave me a FedEx tracking#. I checked it with FedEx's website
and to my surprise, it indicated the Lexus OEM wheels package was delievered
on Monday. The records indicate that the FedEx driver had delivered them
at 1130AM. Obviously I never saw them at all. None of my neighbors had
seen them.
According to the UPS website, their driver showed up at my house at 2pm.
This lead me to guess that the driver might have picked up ALL the wheels
which were probably sitting next to each other at my front door. Unfortunately,
the UPS driver who was contacted denied picking up anything other than what
he was supposed to. When the FedEx rep contacted the FedEx driver, he
also swore that he delivered the wheels to my door.
Now, I cannot prove that the UPS driver picked up the wheels left by the FedEx
driver. (nor do I have a valid reason/evidence to doubthim)
As you can see, I'm between a rock and a hard place... what should my next
course of action be? UPS's postion is that they never picked up the wrong
package, so they're not responsible As for FedEx, they insist the packages
were delievered, but I'm welcome to file a claim of non-receipt
.....any suggestions appreciated...

You didn't sign for the Fedex package, though. Why did they just leave it? Do you have a release on file? Fedex will have to fix this for you, since you never received/signed for your packages.
the package was released/delivered to my door without my signature...
However, she did say that even with a signature release, they will still process a claim...
(not saying that the claim will be paid)

Blame UPS. Worst service ever. Most of their drivers are very disgruntled (that I have personally been in contact with.)
I saw UPS truck cut off a school bus and almost ran some kids over.
Whenever I recieve a package via UPS, it's usually dinged all over the place.
I think the UPS driver is lying. He probably picked up your OEM rims also.

I agree. 90% of the UPS employees I encountered are nice folks.(counter clerks, phone
agents, and of course, drivers)

make a claim with fedex. if the rims were not insured you will be reimbursed 100.00 no more and no less. you have to fill out a claim form and send it back to them with a receipt. the process takes about 2 week eventhough they say 7 days. since fedex was the carrier they are he ones responsible. i went through something like this last year and it wasnt fun.

You will love this - I bet you can NOT make a claim. You are out nothing. The dealer has to make the claim because they are the shipper. You never received them period - no proof on their end. For all you know they were stolen by someone.
Let the Lexus dealer handle it - it is not your problem.

yes doug is right, the shipper must file the claim, therefore if they didnt insure it or request signature its there problem.................. call the lexus dealership and tell them u want your money back for product u did not recieve or you want the product shipped out again............

I see UPS/FedEx/DHL/Airborn guys pushing their carts deliverying packages at malls everyday.
FEdEx guys pass me by.. their packages are nice looking. Nothing Crushed.
Airborn guys pass.... Packages are like FedEx. In good condition.
Same for DHL
But when i see the UPS cart pass by... Some boxes arnt boxes anymore. Everything is crushed & Dirty.
I had some problems with UPS before.. Out of 200 Large packages i've sent out, 30% of them were damaged (crushed) I've Claimed Insurance and till this day, received nothing from them.
Took a $2000+ lost and fixed thing myself between me and my customers. Since then i've never sent any packages through UPS again. FedEX is the way to go.
As for your situation, FedEX is held responsible Unless Lexus asked for a no Sig Required.
Then that will mean LEXUS is liable for your missing packages.

Just so I can cover my base on this, let me make sure you were credited for your wheels. What was your order #? Also, I will double check and make sure we didn't get any Lexus wheels back instead of our wheels.
